On September 7, 2026, at the \u00c9cole de Droit de la Sorbonne (12 Place du Panth\u00e9on, Paris), Professor Federico Pernazza participated as a speaker at “Les Journ\u00e9es Restructuring Franco-Br\u00e9siliennes,” an international seminar convened from September 7 to 9, 2026. The symposium was promoted by the Sorbonne Insolvabilit\u00e9 et Restructuration (SIR) Center of the Institut d’\u00c9tudes Judiciaires at Paris 1 Panth\u00e9on-Sorbonne, in collaboration with UNINOVE and the Accademia Juris Roma.<\/span><\/p>\n

The initiative convened members of the judiciary, legal scholars, and practitioners from Brazil, France, and Italy to engage in an interdisciplinary discourse regarding the evolution of corporate law, corporate governance, and insolvency frameworks from a comparative perspective.<\/span><\/p>\n

Within the framework of Session III, which was dedicated to a comparative analysis of the Brazilian, French, and Italian insolvency regimes, Professor Pernazza presented a paper entitled <\/span>“Une crise, plusieurs solutions: les proc\u00e9dures de redressement dans le Code italien de la crise d’entreprise”<\/span>.<\/span><\/p>\n

The presentation traced the evolutionary trajectory of the Italian framework for managing corporate crises, from the 1942 Bankruptcy Act to the current Corporate Crisis and Insolvency Code (Legislative Decree No. 5\/2019). It provided a detailed examination of the five primary statutory mechanisms currently available to distressed enterprises: the negotiated crisis settlement, the certified recovery plan, debt restructuring agreements, the newly introduced restructuring plan subject to judicial ratification, and the arrangement with creditors on a going-concern basis. Furthermore, the paper analyzed the statutory criteria and procedural modalities governing the transition between these frameworks, examined in light of the most recent jurisprudential developments in the domain.<\/span><\/p>\n

Participation in this international symposium underscores the Firm’s enduring commitment to the rigorous comparative study of corporate insolvency law, fostering continuous academic and professional dialogue with principal European and non-European legal traditions.<\/p>\n
