Prof. Federico Pernazza Speaks at the Association Henri Capitant Congress in Rio de Janeiro

From 1 to 3 June 2026, the Brazilian Journées Internationales of the Association Henri Capitant were held in Rio de Janeiro. The annual comparative law conference was dedicated this year to the theme “Insolvency.”

During the session on business restructuring, coordinated by General Reporter Prof. Sheila Christina Neder Cerezetti of the University of São Paulo, Prof. Federico Pernazza presentedthe Italian national report, Les outils de redressement dans le Code de la crised’entreprise et de l’insolvabilité, prepared with the drafting contribution of Dr. Domenico Benincasa.

The report provided a comparative analysis of the five principal business crisis resolution mechanisms established by the Italian Code of Business Crisis and Insolvency, ranging from the negotiated settlement procedure and the certified recovery plan to debt restructuring agreements and the preventive composition with business continuity. It examined the distinctive features, advantages, and practical limitations of each instrument within the Italian insolvency framework.

The Congress, inaugurated at the Office of the Attorney General of the State of Rio de Janeiro in the presence of the President of the Brazilian Federal Supreme Court, Luiz Edson Fachin, and the President of the Association Henri Capitant, Philippe Dupichot, brought together the Association’s national groups for an in-depth comparative discussion on business and consumer insolvency. Once again, the event confirmed its role as a leading forum for dialogue between the European and Latin American legal traditions.
